Georgia inmate returns to stand trial for Fred's shooting | News

FORT PAYNE, AL (WAFF)- Kelly Jack Mayo was brought to the DeKalb County Jail on Thursday.

He will stand trial for the attempted robbery and shooting at Fred's in Rainsville.

Authorities with the DeKalb County Sheriff's Office drove to Polk County, Georgia to pick Mayo up and transport him back to DeKalb County.

Mayo had nothing to say as he was let into the jail.

Mayo was indicted in October on two counts of attempted murder, two counts of discharging a gun into an occupied building, and first degree robbery.

The charges stem from an August shooting of 25-year-old Josh Nance and 39-year-old Matthew Whitt. Both were employees at the Fred's Store in Rainsville.

Mayo is accused of shooting both men in the back. Nance is now paralyzed.

Mayo was caught in Cedartown, Georgia attempting to take a Fred's employee hostage.

Sheriff Jimmy Harris said Georgia authorities agreed to release Mayo to Alabama provided Mayo waive extradition back to Georgia after trial.

Mayo must go before a judge in the next 72 hours. The hearing date is not yet set.
